NEW DELHI — In a major move to streamline compliance and resolve long-standing regulatory gaps, the Employees’ Provident Fund Organisation has officially rolled out the Amnesty Scheme 2026. This new initiative provides a one-time, six-month window for establishments operating private Provident Fund trusts to retrospectively regularize their legal status and secure formal exemption under the EPF Act and the Code on Social Security.

The scheme, which was formally notified on June 29, 2026, is set to remain open until December, offering a crucial lifeline to employers seeking to align with updated statutory frameworks without facing protracted legal disputes.

What is an 'Exempted Provident Fund'?

Typically, employee provident fund contributions are managed directly by the central retirement fund body. However, under specific conditions, an employer can set up a private trust to manage these contributions internally. These are known as "exempted" trusts.

Even though these funds are privately managed, the trusts must still strictly comply with stringent rules set by the Income Tax Department and the Ministry of Labour and Employment. Following recent amendments aligning income tax frameworks with provident fund laws, only trusts with an explicit exemption under Section 17 of the EPF Act will be recognized for tax benefits.

Who is Eligible for the Scheme?

The amnesty is targeted at a specific group of organizations—ranging from small businesses to large corporate enterprises—that currently manage a PF Trust recognized under the Income Tax Act of 1961, but crucially lack a formal exemption notification from the appropriate central or state government authorities.

Pending assessments for dues and damages will be withdrawn, provided that member accounts received contributions and interest at rates equal to or higher than the statutory rates. This gives employees greater clarity and security regarding the legal standing of their retirement savings.

  • Streamlined Compliance: By formalizing these trusts, the initiative brings them into a consistent statutory framework, simplifying future administration, easing audit processes, and ensuring long-term legal compliance under the new Code on Social Security.

How to Apply for Regularization

The application process has been designed to be straightforward and digitally accessible. Regional offices have been tasked with facilitating the transition and guiding employers through the necessary steps.

Establishments wishing to avail themselves of the amnesty must submit a formal application addressed to the Centre. The submission route is entirely digital; applications can be sent via email to the jurisdictional Regional Office.

Interested organizations can kickstart the process immediately by emailing an expression of interest directly to the central exemptions cell at the official designated channel.

With the December deadline approaching, legal and financial experts are advising companies operating un-regularized private trusts to act swiftly to avoid future compliance hurdles and secure their tax-exempt status.
