The Bar Council of India (BCI) has issued a strict directive mandating a nationwide physical inspection of all affiliated law colleges to elevate the standard of legal education across the country. This comprehensive regulatory move comes in direct response to oral observations made by the Supreme Court of India during the hearing of K.R. Sudersan v. Bar Council of Tamil Nadu and Puducherry, which highlighted critical concerns regarding the continued operation of deficient law institutions.

Mandatory Physical Inspections Under the new directive, universities can no longer rely on affidavits, photographs, or submitted documents to grant or renew affiliations. The BCI has instructed Vice-Chancellors and Registrars to conduct thorough, on-site physical visits to every affiliated Centre of Legal Education. Inspection teams are tasked with verifying the actual presence and functionality of essential infrastructure, including libraries, internet and computer facilities, and moot court halls, ensuring they meet the prescribed standards.

Strict Scrutiny of Faculty and Academic Operations A major focus of these fresh inspections is the strict verification of teaching staff. Universities are required to ensure that colleges maintain the mandatory number of qualified, full-time faculty members. The BCI explicitly prohibited the use of part-time or visiting lecturers as substitutes for core, regular faculty. Furthermore, inspection teams must verify teacher attendance and ensure salaries are paid legitimately through official banking channels.

The regulatory body has also taken aim at irregular academic schedules. The BCI ordered the immediate discontinuation of any unauthorized weekend, evening, or shift-based law programs, emphasizing that these proxy arrangements cannot substitute mandatory regular classroom teaching.

Six-Week Deadline and Severe Penalties Universities have been given a firm six-week deadline to complete these extensive physical inspections and submit a consolidated compliance report to the BCI.

The consequences for non-compliance are severe. If a law college is found deficient in its infrastructure or faculty requirements, the affiliated university must immediately initiate steps to withdraw its affiliation. The BCI has also directed universities to actively report any instances of fabricated faculty records, false declarations, misleading photographs, or unauthorized excess admissions detected during the on-site visits. Institutions failing to adhere to these standards face a complete withdrawal of BCI approval.
