The Allahabad High Court has dismissed a writ petition challenging the proposed demolition of buildings at Mohammad Ali Jauhar University, ruling that the plea was not maintainable as it was filed by an unauthorized individual rather than an official representative of the institution.

The Core Objection: 'Stranger' to the University- The petition, which sought to halt the demolition proceedings initiated by the Rampur Development Authority (RDA), was filed by Mohammad Yusuf, a businessman acting as a pairokar (pleader) for the university.During the hearing, the Uttar Pradesh government, represented by Additional Advocate General (AAG) Anupam Trivedi, raised a preliminary objection regarding the maintainability of the petition. The state argued that a university is a legal entity that must be represented by its Registrar or a competent official employed by the institution. The AAG contended that a "stranger" or an external individual like a businessman has no locus standi to approach the court on behalf of the university.

Court's Ruling- Justice Saurabh Shyam Shamshery accepted the state's objection, observing that the records confirmed the petitioner was indeed an outsider with no official standing within the university administration. Consequently, the court refused to entertain the petition.In its order, the bench noted that dismissing the plea on these technical grounds would allow the ongoing proceedings against the university and its trust to reach their "logical conclusion.

Context: Demolition Row - The legal battle stems from notices issued by the Rampur Development Authority, which had ordered the demolition of several university buildings allegedly constructed without approved maps. While the High Court declined to hear this specific petition, reports indicate that the university had separately secured interim relief from the Moradabad Divisional Commissioner, who stayed the demolition of 38 buildings pending a final hearing.
